The Scottish Statutory Duty of Candour
The current edition of the Edinburgh Law Review includes a commentary by Ampersand Advocate David A. Stephenson Q.C., on the duty of candour recently imposed on Scottish health service, care service and social work providers by Part 2 of the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act: The Scottish Statutory Duty of Candour, EdinLR Vol 20 pp224-229.
David’s article provides a summary of the salient points of the new system and identifies areas that will require clarification by secondary legislation, and in the course of implementation. Matters are identified that should assist practitioners identify the possible issues that might arise for their clients once the new system is in place. More generally the paper reflects the ongoing engagement by Ampersand Advocates with national developments in the the delivery and regulation of medical and social care services within Scotland.
