Ampersand advocates set for UKSC Brexit case
Ampersand’s Aidan O’Neill QC and Douglas Ross QC have been instructed in the landmark UK Supreme Court case of R (on the application of Miller & Dos Santos) v Secretary of State for Exiting the European Union.
Aidan O’Neill QC acts as senior counsel for the Independent Workers Union of Great Britain (IWGB) which has been granted permission to intervene. The IWGB have been restricted to written submission.
Douglas Ross QC will act as one of the senior counsel for the Scottish Government which has also been granted permission to intervene.
Counsel for the Scottish Government and for the Independent Workers Union of Great28 Britain were invited to address in their skeleton arguments the relevance of points of Scots Law, so far as they do not also form part of the law of England and Wales, to the determination of the present proceedings. The case is on appeal to the UKSC after the High Court ruling that the Prime Minister could not use her prerogative to send notification to the EU of the UK’s withdrawal of membership.
The case will be heard at the UKSC week commencing 5th December 2016. It will be streamed live via the Supreme Court website at: https://www.supremecourt.uk/live/court-01.html.
Judgment will not follow immediately on conclusion of the hearing. A decision will follow in the New Year.
