International Law
Ampersand has extensive experience in private and public International Law matters. Some of the work our members do has an international aspect.
In private international law matters our members regularly advise and act in a range of issues, mainly disputes between individuals or companies with a foreign element. These disputes include issues regarding the law governing a particular legal problem where one of the parties is a foreign company or the action takes place abroad (including Ministry of Defence claims or private personal injury claims including shipping and aviation matters), whether the Scottish courts have jurisdiction to hear an action, where a company domiciled or dispute on its Centre of Business is, and the enforcement of a foreign court’s order in Scotland.
In relation to public international law our members regularly advise and act in a range of issues including international treaties and conventions and claims under domestic law as they effect international rights, such as the European Convention on Human Rights on claims under the Human Rights Act 1998.
Members have appeared in the European Court of Human Rights, the Court of Justice of the European Union and the Court of Arbitration for Sport.
Our members have written extensively on International Law issues, including leading texts such as ‘EU Law for UK Lawyers’ and forthcoming publications arising from the UK’s departure from the European Union in respect of forging new trade agreements.
